Terms of Service

OnSite Mitigation & Restoration provides water damage mitigation, mold remediation, emergency roof tarping, and sewage/biohazard cleanup services in Winter Haven, FL and surrounding Central Florida communities. Submitting a request through the Site is a request for a quote and dispatch — it does not create a service contract until a separate written work authorization is signed on-site.

You must be at least 18 years old and authorized to request services for the property described. By submitting a request, you represent that you are the owner, tenant, or authorized agent.

We strive to respond to emergency calls 24/7 with typical on-site arrival within 60–120 minutes in our primary service area. Response times are estimates only and may be affected by weather, traffic, storm surge demand, distance, and crew availability. For active life-safety emergencies, call 911 first.

• Estimates provided before on-site inspection are preliminary. Final pricing is determined after assessment and documented in a written work authorization.
• Charges may include labor, equipment usage, materials, disposal fees, and emergency/after-hours rates.
• Payment terms, including any deposits, deductibles, and assignment of insurance benefits, are described in your work authorization.
• You remain responsible for any amounts not paid by your insurance carrier.

We frequently coordinate directly with insurance carriers and adjusters, but we do not guarantee that any specific charge will be approved or paid by your insurer. Coverage decisions are made by your carrier under your policy.

• Provide safe access to the property and accurate information about the loss.
• Disclose known hazards (electrical, structural, chemical, biological) before crews arrive.
• Keep children and pets out of active work areas and containment zones.
• Notify your insurance carrier of the loss as soon as reasonably possible.

You agree not to misuse the Site, including by submitting false service requests, attempting to gain unauthorized access, interfering with operation, or using the Site in violation of any law.

All content on the Site — including text, graphics, logos, and photographs — is owned by or licensed to OnSite Mitigation & Restoration and is protected by applicable laws. You may not reproduce or redistribute Site content without our prior written permission.

The Site and its content are provided "as is" without warranties of any kind, express or implied. Information on the Site is general and not a substitute for on-site professional assessment. We disclaim all implied warranties to the fullest extent permitted by law.

To the maximum extent permitted by law, OnSite Mitigation & Restoration and its owners, employees, and contractors are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Site. Liability for on-site services is governed by the written work authorization signed at the time of service.

You agree to indemnify and hold harmless OnSite Mitigation & Restoration from claims arising out of your misuse of the Site or your breach of these Terms.

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Polk County, Florida.

We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
